장애인의 생활 수준은 국가와 사회의 문명화 정도를 나타내는 척도다.
‘운전결심’ 모바일 앱 서비스는 현재 수도권은 서울 10개 구청. 경기지역은 22개시와 1개 군, 강화도를 제외한 인천광역시 전역, 대구광역시 6개 구청. 대전, 광주, 부산광역시 전역과 강원, 충북, 전남, 전북, 경북 일부 지역에서 서비스를 제공 중이며, 모바일 앱 방문자는 연간 20여만 명에 달한다.이는 연간 1종과 2종 신규 면허 취득자 70~80만 명의 4분의1에 해당하는 수이다.
다만 학원의 명칭을 사용하지 않고 운전학원과 비슷한 상호를 쓰며 유상 운전 교육을 제공하는 것은 가능하다고 전해졌다.
이 같은 활동으로 ‘운전결심’ 이용 고객을 대상으로 한 설문조사 결과, 불법 연수를 인지하는데 도움이 됐다는 응답이 92%에 달했다. 운전결심은 코로나19 시대에 적합한 비대면 예약지원 시스템과 원스톱 결제과정을 통한 편의성과 안전성으로 향후 운전연수 시장에 획기적인 변화를 가져올 것이란 분석이다.현대차 관계자는 “운전 연수 매칭 모바일 앱 플랫폼인 ‘운전결심’은 합법적인 운전 연수 확산을 위해 민.관.기업이 협력해 건전한 교통 문화를 만들어 나간다는 점에서 큰 의미가 있다”고 밝혔다.수원운전연수7일 오후 방송되는 SBS '미운 우리 새끼'에서는 김준호의 장롱 면허 탈출을 위한 지원사격에 나선 김지민의 모습이 그려진다.
현재 장애인 운전과 관련해 보건복지부는 장애인복지법에 따라 장애인복지정책을 총괄하고, 보건복지부 소속 국립재활원에서는 장애인 운전재활교육을 실시하고 있다.
우리 대법원도 위와 같은 점을 고려하여 “비록 그 교육의 주체가 사용자가 아닐지라도 여객자동차법 제25조 제1항에 근거를 둔 운수종사자에 대한 보수교육시간은 근로시간에 포함된다고 봄이 타당하다”고 판결했다(대법원 2022. 5. 12. 선고 2022다203798 판결).
장애인의 관점에서 본다면 이러한 기능들이 모두 통합되고 조정된(integrated and coordinated) 형태로 제공될 필요가 있으나 장애인이 개인적으로 다양한 기관들의 사업에 관한 정보를 모두 알지 못하는 것이 현실이다.
장애인의 운전 가능 여부를 운전자 및 자동차면허청(Driver and Vehicle Licensing Agency: DVLA)의 의료자문인이 담당하고, 장애인 운전면허 취득교육은 영국 전역에 소재하고 있는 장애인운전센터(Mobility Centre)를 중심으로 이루어지고 있다.
특히 복지부 국립재활원은 1994년부터 국내 최초로 장애인 무료 운전교육을 시작했고, 지체, 뇌병변, 청각장애인 중 운전보조기기가 장착된 차량이나 수어로 의사소통이 필요한 전국의 장애인을 찾아가고 있으며, 운전면허취득, 중도장애인 운전적응, 도로연수, 국립재활원 입원 환자를 대상으로 운전체험 교육을 실시하고 있다.
대중교통 수단을 장애인 친화적으로 전환할 수 있으나 많은 비용이 소요되고, 장애인 콜택시 등 특별 교통수단도 현재 활용되고 있으나 재정적 한계가 있으므로 수요를 감당하지 못한다.
현대자동차가 초보 운전자들의 사고예방과 불법 운전연수 근절을 목표로 지난 2020년 10월 출시한 모바일 앱 ‘운전결심’이 2년 여 만에 초보 운전자들의 필수 앱으로 자리를 잡아가고 있다.
실제 지난해 불법도로연수를 2천300건 적발하고, 19명 검거했다는 전북경찰청의 설명이다.
다만 위와 같은 판결이나 행정해석에도 불구하고 모든 직종의 보수교육이 근로시간에 해당한다고 오해해서는 안 된다. 예컨대 변호사 의무연수의 경우, 변호사의 전문성과 윤리의식을 높이기 위하여 시행되는 것으로(변호사법 제85조), 반드시 직무교육의 일환이라 보기는 어렵다. 그 의무연수를 이수하지 않았다 해서 법무법인 등 회사가 해당 변호사를 사용할 수 없는 것이 아니어서 근로제공에 필수적인 요소라고 볼 수도 없다. 그 불이익인 과태료 또한 회사가 아닌 변호사 개인에게 곧바로 가해진다. 따라서 이러한 변호사 의무연수시간의 경우 앞선 판례나 해석에 따르더라도 근로시간으로 보기는 어려울 것으로 판단된다.
‘운전결심’ 모바일 앱이 초보 운전자들의 관심을 끄는 이유는 앱 이용자들의 만족도가 크게 높기 때문으로 분석된다.
자신이 원하는 지역에 위치한 ‘운전결심’ 제휴 학원이 매칭 되면 최종 내역을 확인한 후 결제를 하고, 확정된 연수 일정에 학원을 방문, 연수를 받으면 된다. 이러한 과정은 고객에게 카카오톡으로 실시간으로 안내된다.
법은 어떻게 되어 있을까? 근로기준법 제50조 제2항에서는 작업을 위하여 근로자가 사용자의 지휘, 감독 아래에 있는 대기시간 등은 근로시간으로 본다고 규정하고 있다. 휴게시간이든 대기시간이든 근로자에게 일시적으로 자유가 주어지더라도 실질적으로 사용자의 지휘, 감독 아래 놓여 있는 시간이라면 이는 근로시간에 해당한다고 명시하고 있다.일을 하려면 일을 하기 위해 여러 준비를 하거나 교육을 받아야 한다. 또 일이 끝난 이후에도 작업을 정리하고 정돈해야 하는 이러한 시간들은 ‘일’을 하는 시간은 아니지만 ‘일’을 하기 위한 시간이므로 근로시간에 해당한다.
장애인의 이동권을 실현하는 방법은 대중교통 이용증진과 콜택시 등 장애인에 대한 특별 교통수단 지원, 장애인 자가운전 편의 등으로 나눌 수 있다.
위와 같은 판례와 행정해석을 종합하면, 교육이 직무와 관련되어 있다는 전제하에 직접적으로 회사가 교육 참가를 지시하지 아니하였고 그 교육이 회사 차원에서 이루어지는 것이 아니라고 하더라도, 관련 법령에 따라 참석이 의무화되어 있고, 불참 시 관련 법령에 따라 회사가 사실상 근로자에게 불이익을 주어야 하는 교육이라면 그때의 교육시간은 근로시간으로 해석될 수 있다.

현행법상 자동차운전전문학원을 통하지 않은 운전 연수는 모두 불법이며, 이를 이용하다 사고가 발생하더라도 법적인 보호를 받기가 어렵다.
23일 전북경찰청에 따르면 현행 도로교통법 제117조에 따르면 ‘자동차 운전학원으로 등록하지 않은 자는 운전 학원과 유사한 명칭을 사용해 상호를 게시하거나 광고를 해서는 안 된다’고 규정돼 있다.
살벌해진 분위기 속 김준호는 분위기 만회를 위해 차 서랍에서 깜짝 선물(?)을 꺼내 김지민을 놀라게 만들었다. 과연 스튜디오를 웃음바다로 만든 선물의 정체는 무엇일지, 이날 오후 9시 5분 방송되는 '미운 우리 새끼'에서 공개된다.안산운전연수일각에선 운전 시뮬레이터가 아무리 정교해도 실제 도로와 다른 만큼 안전 우려가 있고, 가상에서 모든 걸 대체할 경우 그것을 현실처럼 강력하게 받아들일 수 있다는 지적이다.
경찰 관계자는 “무등록학원·무자격강사로부터 교습을 받다가 사고가 나게 되면 보험적용을 받을 수 없다”며 “싼 가격만 생각지 말고 실제 교통안전을 위해서 정식 학원을 통해 운전면허를 취득하길 당부한다”고 말했다.

미국은 주마다 운전면허제도가 다른데, 뉴욕주는 장애인 운전면허 취득 및 관리를 담당하는 운전재활 전문가(Driver Rehabilitation Specialist: DRS) 자격제를 도입했다.
김준호는 본격적인 운전 연수 전 김지민에게 "오빠 멋있지?"라며 허세를 부렸지만 이내 겁쟁이로 돌변한 것은 물론, 셀프 주유소에서는 자동차 주유구도 찾지 못해 쩔쩔매는 모습으로 김지민의 속을 태웠다.
한편 도로교통공단에서도 전국 10개소의 장애인운전지원센터를 운영하며 장애인의 면허취득을 위한 운전교육을 실시하고 있다.
정식 운전학원이 아닌 사실상 ‘운전 게임장’인 셈이지만 가격이 싸다 보니 수능 마친 고3 수험생, 대학생 등 주머니가 얄팍한 이들이 주로 찾는다고 한다. 운전 전문학원 수강료는 보통 70만원대인데 실내 연습실은 30만원대로 절반 수준이다.
모바일 앱 ‘운전결심’에 등록돼 있는 자동차운전전문학원들은 모두 경찰청이 인정한 합법적 학원들이어서 안심하고 선택할 수가 있다.
지난 21일 전북지역에서 운영하고 있는 실내운전면허 연습장을 찾았다. 연습장을 찾은 이용객들은 일반 차량과 똑같이 생긴 운전석에 앉아, 앞·좌우를 둘러싼 3면 스크린을 바라보며 면허 시험 코스를 가상현실(VR)처럼 연습하고 있었다.
‘운전결심’은 불법 연수 근절을 위해 현대차가 지난 2020년 10월 경찰청, 안전생활실천시민연합(안실련)과 함께 출시한 합법적 운전 연수를 매칭시켜 주는 비대면. 모바일 형식의 새로운 서비스 플랫폼이다.
이후 과거 이상민과 함께 왔던 운전 연수 학원을 다시 찾은 김준호는 그 때보다 더 형편없어진 운전 실력으로 김지민의 분노를 유발했다. 마치 곡예쇼를 연상케 하는 김준호의 실수 연발에 '참을 인'을 새기던 김지민은 주차 연습 중 좌우조차 구분하지 못하는 김준호의 모습에 결국 폭발하고 만다. 그는 김준호에게 "밥 먹는 손이 어디야?"라고 호통을 쳐 폭소를 유발했다.
저렴하게 운전면허를 취득하려는 시민들에 대해 가상 연습으로 불러올 부작용과 값싼 수업료에 혹했다가 더 큰 값을 치를 수 있기 때문이다. 대책 마련이 필요하다는 목소리도 높아지고 있다.
행정해석도 이와 비슷한데, 고용노동부는 지난 2007년 택시기사의 교육시간을 유급으로 처리해야 한다고 판단했다. 택시기사는 여객자동차 운수사업법령에 따라 신규채용 시 20시간 이상, 재직 중에는 시·도지사가 지정한 교육을 각각 받아야 한다. 이런 교육을 받지 않을 경우 자격정지의 처분을 받는다는 점, 택시사업주도 근로자가 필요한 교육을 받도록 조치하여야 하고 이를 이행하지 않을 경우 과징금을 부과받도록 관계법령에서 규정하고 있다는 점 등을 그 이유로 제시했다.
게다가 앱 이용을 통한 다양한 혜택도 관심을 끈다. 운전결심 앱에서 연수 결제 시 연수비용 할인과 연수가 끝난 후에는 현대차 신차 구매 할인 등 다양한 혜택이 제공된다.
실제로 작년 6월에는 연수 차량에 소형 카메라를 설치, 여성 수강생들을 불법 촬영해온 불법 연수 강사가 구속됐으며, 9월에는 무등록 학원 운영자와 무자격 강사 등 95명이 무더기로 적발되기도 했다.
다만 장애인 운전교육은 대기를 해야 할 정도로 수요가 많으므로 지역사회에서 장애인들이 운전교육을 편하게 받을 수 있도록 국가적 지원이 필요하다.
‘교육시간도 근로시간일까?’라는 질문은 어떻게 보면 매우 해묵은 주제다. 또 그 결론이 간단해 보이기도 한다. 회사가 의무적으로 시키는 교육이고 불참 시 불이익이 있다면 그 교육시간은 근로시간에 해당한다. 직무교육, 신입사원 교육 등이 대표적이다.
안실련이 실시한 전국 성인남녀 2,000명 대상 운전 연수 인식 설문조사에서도 유상으로 운전 연수를 받은 소비자들 중 약 50%가 불법과 합법의 차이를 모르고 있었던 것으로 나타났다.
자동차 운전학원이 아닌데도 운전교육을 제공하는 실내 운전연습장과 자격증도 없이 불법 도로연수를 실시한다면서 싼값에 시민들을 유혹하는 사례가 크게 늘어나고 있다. 시민들의 주의가 요구되고 있다.
위와 같이 보면 ‘교육시간도 근로시간인가?’라는 물음은 질문할 필요조차 없는 간단한 사안에 해당한다고 생각할 수 있다. 하지만 그 판단이 쉽지 않은 경우가 있다.

교육도 마찬가지인데, 업무를 하기 위해 교육, 연수, 훈련 등을 받는 것은 ‘일’을 하는 것은 아니지만 ‘일’을 하기 위해 준비를 하는 것이라고 볼 수 있다. 이러한 관점에서 본다면 당연히 업무를 위한, 즉 일을 하기 위한 교육시간도 근로시간에 포함되는 것이 타당하다. 우리 대법원도 “사용자가 근로시간을 대체하여 근로자에 대하여 실시하는 교육·연수·훈련 등은 거기에 참가하는 것이 근로자의 의무로서 강제되는 한 근로제공과 다를 바 없다”고 보고 있다(대법원 1999. 11. 23. 선고 99다45246 판결).

장애인도 지역사회의 구성원으로서 경제 및 여가활동에 참여해 인간다운 삶을 누릴 수 있도록 국가가 지원할 의무가 있는데, 그 핵심이 ‘이동권의 보장’이다.
초보 운전자들의 운전 연수는 그동안 금전 사기나 검증되지 않은 강사의 강습, 불법 개조 교습차량 등 여러 사회문제를 야기 시켜 왔다.
대표적으로 회사가 진행하는 교육이 아니고, 회사가 이를 강제하는 것도 아니라면 어떠할까? ‘회사가 진행하는 교육도 아니고 회사가 이를 강제하는 것도 아니라면 근로시간이 아니지 않느냐’는 물음이 생길 수 있다. 하지만 꼭 그렇지만은 않다. 예컨대 일정한 면허 내지 자격을 바탕으로 근로를 제공하는 경우 그 면허나 자격을 유지하기 위해서는 외부기관의 일정한 교육을 지속적으로 이수해야 하는 경우가 많다.
그러나 장애인 자가용 이용은 비용 대비 장애인의 이동권을 실현할 수 있는 효과적인 수단이지만 가장 활성화가 되지 못한 영역이다.
또한 장애인은 사회참여와 취업을 위해 운전이 필요하나 민간 운전학원에서는 강사 확보가 어려워 교육이 이루어지지 않으므로 국가가 직접 무료로 장애인에게 운전재활 교육을 담당할 필요가 있다.
여객, 화물 계열 운수종사자 예컨대 법인택시, 전세버스, 특수여객, 마을버스 운전사가 받아야 하는 교통연수원의 보수교육이나, 변호사나 의사가 받아야 하는 의무연수 등이 대표적이다. 이런 보수교육의 종류와 양태는 다양하다.
이같은 불법 도로연수는 정식 교습비의 절반 수준으로 싸지만 사고가 났을 경우 수리비 폭탄을 떠안게 된다. 또 무자격 불법 영업이어서 보험 적용이 안딘다. 수리비나 치료비를 온전히 교습생이 부담해야 한다.
경찰청은 도로교통법에 따른 장애인 운전면허에 대한 규제를 담당하고, 경찰청 산하 도로교통공단에서는 장애인 운전교육을 실시한다. 고용노동부 장애인고용공단에서는 장애인 운전차량 개조에 대한 재정을 지원한다.
현대차의 ‘운전결심’은 모바일 앱을 통해 운전 연수를 원하는 수요자와 공급자(운전전문학원)를 일대일로 연결시켜주는 합법적 운전연수 매칭 플랫폼이다.포털사이트에는 저렴한 가격으로 운전 연수를 할 수 있다는 운전학원 광고가 넘쳐나고 있고 무허가 운전학원도 수두룩하다.
아울러 운전학원 ‘장애인 센터’에서는 장애인 운전교육용 자동차를 구비해 장애인 운전교육과 운전면허시험에 사용하고 있다. 교육부 특수교육 및 재활서비스국에서는 장애인 차량개조 프로그램을 담당하고, 직업재활사무소에서는 구직활동을 하는 장애인에게 차량 개조 서비스를 제공한다.
결국 교육시간이 근로시간인가 아닌가를 따질 때, 단순히 회사가 직접 하지 않거나 회사가 강제하지 않은 교육이라는 이유만으로 근로시간에 해당하지 않는다고 볼 수는 없다. 여러 사정을 종합해서 과연 그 교육이 업무를 위한 것인지, 불참 시 불이익이 있는 것인지 가려보아야 할 것으로 생각된다. 용인운전연수반대로 회사가 의무적으로 시키는 교육이 아니라 근로자의 자기계발을 위한 교육이고 회사는 비용을 보태줄 뿐이라면, 그 교육시간은 근로시간에 해당하지 않는다. 야간대학원 진학, 어학학원 등록 등이 대표적이다.
외국의 사례를 보면 영국은 지역사회에서 장애인이 운전재활 교육을 받고, 장애수당과 연결된 상담을 통해 보조기기와 차량개조 및 임대서비스 등이 통합적으로 제공될 수 있도록 장애인 운전교육 및 지원체계를 마련했다.
‘운전결심’ 앱에서 연수 신청만 해도 캐롯 자동차보험 가입 시 2만5천원 상당의 SK주유권과 이마트 상품권을, 현대해상 자동차보험 가입 시 3만원의 주유권을, DB손해보험 자동차보험 가입 시 최대 3만원 할인을 받을 수가 있다.
이에 더해 초보 운전자들에게 도움이 되는 최신 교통 법규 등 경찰청의 공지사항과 운전상식, 차량관리 등 운전TIP에 대한 정보도 상시 제공받을 수 있다.운전결심’ 제휴 운전전문학원에도 다양한 혜택들이 주어진다. 현대차는 사회공헌 플랫폼으로 제휴학원의 부담을 최소화한다는 원칙에 따라 제휴비용과 수수료를 면제해 주고 다양한 마케팅활동도 지원한다. 특히, 운전결심 제휴학원 임직원들에게 전용 복지물을 제공하고, 운전학원 편의향상을 위한 학원 관리자 웹사이트와 일대일 대화기능도 제공한다. 이 외에도 ‘운전결심’은 매년 안실련과 함께 불법 운전 연수 바로 알기 캠페인도 실시하고 있다. 현대차/안실련 SNS를 활용해 ‘불법 연수 바로 알기’ 퀴즈 이벤트를 진행하고, 유튜브를 활용해 불법 연수의 위험성을 알리는 등 고객 인식 개선에 나서고 있다.
기존에는 장애를 육체적, 감각적, 정신적인 손상으로 인한 개인적 문제로 보았지만 최근에는 장애를 사회적 문제로 보고 장애인과 비장애인 간의 구조적 차별을 개선하는 것에 초점을 두고 있다.
장애인의 권리에 관한 UN협약(the UN Convention on the Rights of Persons with Disabilities) 제20조에도 장애인의 개인적 이동성(personal mobility)에 관한 지원과 교육 등을 규정하고 있다.
위와 같은 법령에 따라 버스 운전기사의 경우 교통연수원 등에서 실시하는 보수교육 등을 받고 있다. 회사가 직접 하는 교육은 아니지만 버스 운전기사를 하려면 이러한 보수교육을 들어야 한다. 만약 듣지 않았다면 회사는 그 기사에게 버스 운전을 맡길 수 없게 되는 구조다.
첫째, 장애인의 권리 증진을 위한 통합정부(joined-up government) 또는 범정부(whole-of-government)적인 거버넌스를 확립하는 것이 필요하다. 장애인의 이동권 실현이라는 공동의 가치와 목표를 공유하고 부처 간의 경계를 넘어 정보를 교환하고 상호 학습하는 장을 만들며, 지역적으로 기관 간 협력을 이루어냄으로써 촘촘한 서비스 연결망을 구축하는 것이다. 이를 위해 공동으로 추진하는 정책협의체와 연구 활동, 공동예산제, 지역사회 네트워크 구축 보조금, 사회적 기금 등을 활용할 필요가 있다. 둘째, 지역사회 돌봄(community care)의 일부로서 장애인들이 지역에서 생활하면서 운전재활 교육을 받아 취업과 취미, 여가활동을 누릴 수 있도록 개인의 욕구에 대한 상담을 하고 장애인 운전교육, 보조기기 설치, 차량지원 등의 원스톱(one-stop) 서비스를 제공한다. 셋째, 인력과 조직의 확충이다. 지역사회에서 장애인이 운전재활 교육을 받고, 차량 등을 활용할 수 있는 기회를 확대하기 위해 국립재활원에 장애인운전재활센터와 같은 전담조직을 설치한다. 아울러 지역단위의 권역별 재활병원과 장애인운전지원센터를 연계하면서 장애인 운전교육을 담당하는 인력을 확충할 필요가 있다. 넷째, 장애인의 운전 편의를 위한 차량개조와 차량렌트, 장애인 자율주행 자동차 등에 국내 자동차 산업의 기술경쟁력을 활용함으로써 사회적 약자와 상생하는 경제를 육성할 수 있다. 장애인의 이동권은 장애인이 차별받지 않고 건강한 삶을 유지하고 사회활동에 참여하는데 기초가 되는 권리다. 이를 위하여 모든 관계 기관이 협력해 지역사회에서 맞춤형 운전 재활 서비스를 제공함으로써 장애인과 동행하는 따뜻하고 행복한 사회가 되기를 기대한다.
국토교통부는 교통약자의 이동편의 증진법을 통해 장애인을 위한 대중교통수단과 시설, 장애인 콜택시 등의 규제를 담당하고, 산업통상자원부에서는 장애인 차량에 대한 신기술 개발의 업무를 담당하고 있다.
여객자동차 운수사업법에 의하면 운수종사자는 국토교통부령으로 정하는 바에 따라 보수교육 등을 받아야 한다(여객자동차 운수사업법 제25조). 운송사업자는 이러한 교육을 받지 아니한 운수종사자를 운전업무에 종사하게 하여서는 안 된다. 만약 이를 위반한 경우 면허, 허가, 인가 또는 등록이 취소되거나 노선폐지 또는 감차 등의 조치가 취해질 수 있다(여객자동차 운수사업법 제85조 제23호).
장애인의 이동권은 개인적인 건강 유지에 도움이 될 뿐만 아니라 사회의 구성원으로서 참여하는 의미를 지니고 있다.
이런 가운데 등장한 ‘운전결심’은 안전하고 합법적으로 운전을 배울 수 있는 길이 열렸다는 점에서 초보 운전자들로부터 큰 호응을 얻고 있다.
또한, 국내 장애인복지법 제35조에서도 국가와 지방자치단체는 장애인의 편리와 사회참여를 위해 재활 및 자립지원서비스를 제공하도록 하고, 동법 제39조에서는 장애인이 사용하는 자동차에 대한 조세감면 등을 지원한다.교통약자의 이동편의 증진법 제3조와 제27에서는 교통약자가 모든 교통수단, 여객시설 및 도로를 차별없이 안전하고 편리하게 이용해 이동할 수 있는 이동권과 장애인의 자가운전에 대한 지원 등을 규정하고 있다.
전문가들은 운전 교육은 실제 운전에 앞서 기본 안전 운전 지식을 습득하는 중요한 과정인 만큼 정식 허가를 받은 곳을 찾아야 한다는 주장이다.
